Florida Files Lawsuit Against OpenAI and CEO Sam Altman Over Safety Concerns

The State of Florida has filed a lawsuit against OpenAI and its Chief Executive Officer, Sam Altman, alleging that the company prioritised rapid growth and financial gain over user safety.

Filed in a Florida circuit court, the 83-page complaint accuses OpenAI of building its success through the exploitation of user data while failing to adequately address potential risks associated with its artificial intelligence products. The lawsuit seeks to hold Altman personally accountable, claiming his leadership demonstrated a disregard for the potential dangers posed by the company’s technology.

Florida is the first U.S. state to take legal action against OpenAI specifically over AI safety concerns. The lawsuit follows a separate criminal investigation launched by Florida Attorney General James Uthmeier earlier this year.

According to the complaint, OpenAI’s chatbot ChatGPT has allegedly been linked to a range of harmful incidents, including cases involving violence, mental health issues, and the exploitation of minors. The state argues that young users have become increasingly dependent on AI systems that mimic human interaction without sufficient parental oversight or safeguards.

The lawsuit includes multiple allegations, including deceptive and unfair trade practices, negligence, product liability violations, fraudulent misrepresentation, and public nuisance. Florida is seeking financial penalties and court orders requiring OpenAI to strengthen protections for minors and provide clearer warnings about potential risks associated with its products.

OpenAI rejected the allegations, stating that it recognises AI as a powerful emerging technology and has implemented safeguards, particularly for younger users. The company reiterated its commitment to improving safety measures and ensuring its products are used responsibly.

The case marks one of the most significant legal challenges faced by OpenAI to date and could have wider implications for the regulation and oversight of artificial intelligence technologies in the United States.
